Derby Building Products Inc. (“Derby Building Products,” “we,” “us,” or “our”) is a manufacturer of exterior polymer stone and shake cladding products. Our Tando® Composites and Novik families of brands and other brands are sold commercially through traditional building product channels such as distributors, lumberyards, and home improvement retailers.
In this Privacy Policy, we explain how we collect, use, and share personal information (defined below) about visitors to our websites (the “Sites”) and others with whom we interact in the course of our business (“you” or “your”). When you visit our Sites, provide information to us, or communicate with us in other ways, you are agreeing to the collection, use, and processing of your personal information as described in this Privacy Policy. If you do not agree with the terms in this Privacy Policy, please do not use our Sites and do not provide any personal information to us.
We may make changes to this Privacy Policy from time to time, so please be sure to review it from time to time to learn about our most recent practices. Changes to this Privacy Policy will be posted on our Sites and will be effective when posted. Your continued use of the Sites or communications with us following the posting of any changes constitutes your acceptance of our Privacy Policy as revised.
2. Scope of our Privacy Policy
Derby Building Products primarily sells products and services to commercial customers. We do not sell our products and services directly to residential customers. However, we ship samples of some of our products to consumers on request, provide assistance in locating stores and retail outlets for our products, and make available design services provided by business partners. Some features on our Sites help residential consumers learn about our products and how the consumer may use them.
We use the term “personal information” in this Privacy Policy to refer to information that identifies, relates to, describes, or is reasonably capable of being associated or linked, directly or indirectly, to you or your household. The personal information we may collect about you will depend on how you interact with our Sites. The categories of information we may collect are listed below. For additional details, see the section titled “Sources and Types of Information We Collect.”
- Contact Information: This includes your name, username, email address, postal address, and phone number.
- Payment Information: If you make a purchase, we, or our third-party processors, collect payment card numbers, financial account information, billing address, and other payment details.
- Content and Files: We collect any photos or other files you provide to us.
- Transaction and Purchase Information: When you make a purchase, we gather information about the transaction, which may include product details, purchase price, date, tender type, transaction location, shipping/delivery details, payment type, and payment authorization. This may also include any account notes you provide regarding the transaction.
- Internet Identifiers and Device Information: When you visit our Sites, our web servers automatically log your Internet Protocol (IP) address and details about your device, including unique device identifiers, device type, operating system and version, browser type and language, other software settings and configurations, and mobile network information.
- Site Usage and Session Information: We automatically log activities on our Sites, which includes the URL of the website from which you arrived, pages viewed, access times, and other details about your interactions with our Sites. We also collect information on the products and services you browse, search for, or express interest in.
- Call Recordings: We may record telephone calls when you interact with us by phone.
This Privacy Policy does not cover the following types of information: publicly available; aggregated, anonymized or pseudonymized; collected by social media and third-party websites you reach by navigating from links on our Site; or information about our current and former employees or job applicants.
3. Sources and Types of Information We Collecty
The sources, types, and use of personal information and other information we collect are described below.
When you open an online customer account or place a sample order, you will be asked for your name, company name, street and e-mail address, phone number, and to create an individual password to log on to our sample portal. Your shipping, billing, and order history will be stored in your account.
If you are a consumer and request a product sample or product information, we will ask for your name, e-mail address, shipping address, phone number, and credit card information for billing purposes (if applicable). If you request information about our products, we will ask for location information so we can direct you to building product dealers or home improvement retailers in your area.
When you make an online payment, your payment information is collected and processed by a third-party payment processor and not by Derby Building Products. Payment information you submit will be subject to the processor’s privacy policy, rather than this Privacy Policy. Payment processors are not permitted to use your information for their own commercial purposes. We may retain limited card information to record and track your purchases.
When you use the Visualizer feature and interactive 3D modeling applications, which are available on some of our Sites, you can upload your own photograph or select a model to create a visual simulation of how our products may look if installed at your home or selected location. Depending on the services you request, you may be asked to provide your address, photos, names, email addresses, phone number, employer’s name, profession, and payment card information. The third-party services that host these applications will have access to the personal information you submit and they collect via tracking technologies. When you communicate with us by phone or an interactive feature available on some Sites, we may record the communications for quality purposes and in order to follow up with you, for example, when you call for information, submit an online form, or use a chat feature, or watch a tutorial video.
When you visit our Sites, we use internet technologies including cookies, pixels, web beacons, and similar tracking technologies (collectively, “cookies”) to collect information about your device, browser, and Site interactions including, for example: (1) your device ID and IP address, which is a unique set of numbers assigned to your computer by your Internet Service Provider; (2) the type of browser and operating system you use; (3) your session activities while visiting our Sites such as time and duration of your session, page navigation, content and time viewed and searched for, page response times, page interactions, and similar data; and (4) technical data such as occurrences of errors, diagnostic reports, and settings preferences.
Other sources of personal information may include our authorized dealers, builders, contractors, and other business partners and any affiliated companies.
4. How We Use Personal Information
We may use personal information for the following business purposes:
- Registering new customer accounts;
- Confirming orders and arranging shipping and delivering of samples;
- Responding to requests for information, questions about orders, and providing customer support;
- Providing marketing and promotional information about our products and services, unless you opt out (for residents of Canada or where otherwise required by law, we will obtain your consent for marketing activities; for U.S. residents, see the section below titled “Your Choices About Marketing Communications.”);
- Advertising our products, including targeted online and social media advertising unless you opt out (for information about opting out of the sale or sharing of personal information, see the section below titled “How You Can Restrict Cookies”);
- Making design and modeling features available to visitors to our Sites;
- Requesting comments about our products through surveys and other customer satisfaction tools;
- Collecting and analyzing data collected about visitors’ usage of our Sites to develop consumer profile information for marketing campaigns and to improve the performance and functionality of our Sites (see “How We Use Cookies and Other Internet Tracking Technologies”);
- Detecting, preventing, and addressing technical issues and preventing potential fraud or misuse of our Sites;
- Responding to law enforcement requests and as required by applicable law, court order, or governmental regulations; and
- In other ways we notify you at the time we collect your personal information.
5. Information Sharing and Disclosure
Your personal information may be accessible to, or shared with, the categories of third parties described below. We do not sell your personal information to third parties such as data brokers for monetary or other valuable consideration. With your consent, we may provide your personal information to our retailer and construction business partners to contact you if you authorize us to do so. We also use tracking technologies on our Sites by which third party advertising and analytics services may access data about your device and browsing activities. Service Providers. We engage third-party service providers to assist with various administrative and technology services including hosting our Sites, cloud data management and storage, contact management, e-mail marketing, payment processing, and other business operations. These providers may have access to your personal information to perform their services on our behalf, but they are not authorized to disclose or use personal information for their own commercial purposes.
Business Partners. With your consent, we may share your information with dealers, builders, contractors, and retailers that we authorize to sell or use our brand products and services.
Site Hosted Services. We use third-party cloud-based software and hosting services to provide certain interactive functionalities for our Sites. See the section titled “Links to Third-party Features, Social Media, and Other Websites.” For example, we use Shopify to process online orders for samples of Beach House Shake, TandoStone, TandoShake, NovikStone, and NovikShake products. Our Design Your Home and Professional Services features, hosted by Renoworks, enable visitors to our Sites to create or obtain an interactive 3D model of how our products may appear on their home. Data Analytics Providers. When you visit our Sites, we and third-party data analytics services, use cookies and other internet tracking technologies to collect device and usage data from visitors to our Sites. Statistical reports and analysis from this data helps us understand how our customers use our Sites and to improve performance and security. Third-party data analytics providers, such as Google Analytics, may also use the aggregated data they collect on our Sites for their own purposes. Advertising Services and Social Media. Cookies and other tracking technologies on our Sites allow us and our authorized advertising partners (including ad networks and social media platforms) to collect and combine device and usage data from visitors to our Sites with data collected from other websites. This information is used to build profiles of internet consumers and display ads and marketing campaigns that are intended to reflect their interests and preferences as inferred from their internet activities over time and across many websites. Legal Process and Security. We may disclose personal information to third parties to detect and prevent fraud, enforce our Sites’ Terms of Use and other agreements, comply with legal requirements, respond to and resolve claims or complaints, and for other risk management purposes, and to respond to law enforcement or legal process or a request for cooperation by a government entity.
Business Transactions. We may share personal information as reasonably necessary in connection with business transactions such as a transfer or sale to another entity of all or a portion of our stock, assets, or other business structuring or reorganization transactions.
6. How We Use Cookies and Other Internet Tracking Technologies
We use the term “cookies” in this Privacy Policy to refer to various internet tracking and local storage technologies including pixels, local device storage, web beacons, scripts, device identifiers, and similar internet technologies. Cookies serve many purposes on our Sites including, for example, to enable some Sites’ functions to operate, track when you visit and how you use our Sites, and operate marketing and advertising campaigns.
These technologies enable us and website hosting services, analytics and advertising providers, social media platforms, and other third parties to collect and combine information about your online activities over time and across different websites and apps. For example, they allow us to determine how many people are visiting our Sites, whether visitors are new or repeat visitors, which pages visitors are viewing and for how long, how people are interacting with our Sites, or how effective our online advertising campaigns are. They support the way we serve our ads, measure the effectiveness of ads we display on other websites and social media platforms, and direct the content and the manner of advertising based on your interests.

The types of cookies we and authorized third-party services may use on our Sites are described below.
Necessary cookies are necessary for the Sites to function and cannot be switched off in our systems. These cookies do not store your name or other information that directly identifies you and are deleted when you close your browser.
Functionality cookies allow the Sites to perform certain functions based on actions you take such as remembering your username for logging in to your account, language, the region you are in, and your cookie preferences. You can set your browser to alert you to these cookies, but some parts of our Sites will not work if you block these cookies.
Advertisement cookies are usually set by advertising networks and social media advertising platforms, such as Google Ads and Facebook, to track your internet browsing activities over time and across many different websites, applications, and platforms you visit and devices you use. These platforms place an advertising cookie on your browser to identify you as a unique user when you visit websites and applications they monitor. This enables the networks and platforms to build a profile of your interests and preferences and deliver advertisements and marketing campaigns targeted to you. Personalized interest-based advertising is commonly referred to as “targeted advertising.”)
Targeted advertising may also be used for retargeting, which is a marketing technique directed to reach previous visitors to our Sites through ads on other websites or by e-mail. Retargeting is also used to limit the number of times you see an advertisement and measure the effectiveness of our marketing campaigns.
The advertising mechanisms we use do not collect directly identifying information such as your name, email address, postal address, or phone number. However, the third-party platforms may store your IP address, device identifier, and other data that identify your browser or device, and the third-party platforms may be able to correlate data to identify individuals.
Advertisement cookies also include social media cookies. We use the Meta (Facebook) pixel and other social media cookies to collect, for example, purchase information, web activity, IP address, device and browser characteristics, and timestamps of visits. These cookies help us to analyze the effectiveness of advertisements we post on social media. You can restrict the use of cookies for targeted advertising purposes when you visit our Sites and as explained in the section titled “How You Can Restrict Cookies.”
Analytics cookies help us understand how our Sites perform, how visitors interact with the Sites, and measure statistics about usage of the Sites. HubSpot, Google Analytics and other website analytics services may use cookies to collect a wide range of data such as: IP address or device identifier; type of device, operating system, and browser used; visit time, duration, and pages viewed; and internet locations before and after visiting our Sites. These services also set a cookie to identify you as a unique user when you visit the Sites again. For targeted advertising purposes, the data collected using analytics cookies may be combined with data from advertisement cookies to show more relevant ads across the web and to measure interactions with the ads we show. E-mail cookies transmit information about how you interact with our e-mail communications such as whether and when you open an e-mail, what links you click within the e-mail, and if you forwarded it.
7. How You Can Restrict Cookies
As explained in “How We Use Cookies and Other Tracking Technologies,” we allow third-party analytics providers, advertising networks, and social media platforms (such as Google Analytics, Google Ads, LinkedIn Ads, and Facebook Ads) to track visitor interactions with our Sites.
Third-party cookies generally do not disclose directly identifying personal information to the data analytics, advertising, or social media platforms. However, these platforms may combine data collected on our Sites with data from other websites they monitor and then use the aggregated findings to build user profiles and for other commercial purposes. These services also may have means of correlating data from our Sites to an identifiable individual, in which case the processing of personal information will be the responsibility of the third-party service and should be explained in their posted privacy policies.
Most browsers have an option for limiting or restricting cookies, which will prevent your browser from either accepting new cookies or allow you to decide whether to accept certain cookies. You can also delete cookies that are already on your browser or device. If you do this, however, it may impact the overall functionality of some features of the Sites and services. Listed below are some ways you can select certain privacy preferences and limit how cookies collect data on our Sites. Derby Building Products is not responsible for the effectiveness of, or compliance with, any third parties’ opt-out options or programs or the accuracy of their statements regarding their programs.
- Visiting our Cookie Settings link and selecting certain privacy settings.
- Managing the cookie and privacy settings on your device or browser.
- Configuring your ad and privacy settings through your accounts on social media and advertising platforms where you have an account (for example Google and Facebook).
- If available, configuring an opt-out preference signal on your browser or platform, to tell us not to use your personal information for targeted advertising, which we will follow as required by applicable law.
- Installing the Google Analytics opt-out browser add-on, which is described on the Google Analytics Opt-out Browser Add-on page at https://tools.google.com/dlpage/gaoptout.
- Purchasing or downloading a utility from an independent software provider that you install on your computer browsers to limit tracking of your browsing activity.
Additionally, you may limit the use of mobile device advertising identifiers by adjusting your advertising preferences on mobile devices through your device settings:
- iOS Devices: Go to Settings > Privacy & Security > Apple Advertising > Personalized Ads
- Android Devices: Go to Google Settings > Privacy > Advanced > Ads > Opt Out of Ads Personalization
Certain coalitions of advertisers allow consumers to opt out of receiving interest-based advertising from their members. Please follow the links below to opt out of interest-based advertising from these coalitions. You will need to exercise these opt-out options on each browser and device where you wish to opt out.
Please note that even if you restrict the use of cookies, you will still see advertisements while browsing online. However, the advertisements may be less relevant to your interests.
8. Your Choices about E-mail and Telemarketing
When you submit your contact information to Derby Building Products, you will be authorizing us and/or authorized sellers of our products to send you marketing or promotional communications (by mail, e-mail, telephone, text message, or voicemail transmission).
You may, at any time, direct us to stop sending you marketing messages by using the “unsubscribe” feature provided in our e-mail messages, or by texting “STOP,” or by contacting us as explained in the section titled,“How to Contact Us.” Please note that it may take several days to process your request, and you may continue to receive the messages until the processing is complete (up to ten days for emails and seven days for text messages).
If you unsubscribe from receiving these messages, you will still receive transaction-related and other communications that are not marketing or promotional in nature. For example, we may contact you concerning any purchases you have made with us, even if you opt out of receiving unsolicited marketing messages.
9. Protection of Personal Information
We maintain commercially reasonable security procedures and practices appropriate to the nature of the categories and specific items of personal information we collect. However, neither people nor systems can operate in a fully secure manner and no method of transmission over the Internet or method of electronic data storage is fully secure. While we use reasonable efforts to protect your personal information and select third-party service providers and, we believe, also use reasonable precautions, we cannot guarantee the security of the personal information you provide to us.
Some of our Sites permit you to create an account. When you do, you will be prompted to create a password. You are responsible for maintaining the confidentiality of your password, and you are responsible for any access to or use of your account by someone else who has obtained your password, even if you did not authorize that person. You should notify us of any unauthorized use of your password or account, and, if any unauthorized use is suspected, you should immediately reset your password.
If you have reason to believe that your interaction with us is no longer secure (for example, if you feel that the security of any account you have with us has been compromised), please immediately notify us of the problem at the contact information provided in “How to Contact Us” section.
10. Retention of Personal Information
We retain personal information as long as your account or transactions are active and then for an additional period to comply with legal obligations, implement our document retention program, resolve disputes, enforce agreements, and for marketing purposes. When we no longer have a business or legal reason to keep your personal information, we will delete, destroy, or de-identify (anonymize) the information. In determining retention periods, we take into consideration any contractual obligations, applicable laws, and business considerations we reasonably believe are compatible with your expectations and the purposes for which we collected your personal information.
11. Links to Third-party Features, Social Media, and Other Websites
Our Sites contain links to features, social media, and websites operated by other companies (“third parties”). When you click on any of these links, you will leave our Site and be transferred to an internet location operated by the third party. That third party will have access to any personal information you submit and may set cookies and other tracking technologies on your browser or device. We recommend that you review the privacy policies of these third parties before sharing any information with them. We have no control over and assume no responsibility for the content, accuracy, privacy policies, or practices of any third-party platforms or websites.
Data collection and interactions with you on any third-party platform are subject to the third party’s privacy practices and policies. Derby Building Products is not responsible for the privacy practices of these third parties. For information about how these third parties collect and manage personal information, we recommend that you review their privacy policies and practices.
Third party Features. Our Sites use third-party applications to power some features, for example, to manage our online store (Shopify), customer account portal, and the design and visualization features (Renoworks). Some of these third-party features are branded with our logo (such as Tando or NOVIK), even though they are not operated or controlled by us. These third-party applications are able to access and collect data from your use of these features, including your personal information.
Shopify. Our online store is hosted on Shopify Inc. (“Shopify”). Shopify provides the online e-commerce platform that allows us to sell samples of some of our products. Shopify is responsible for collecting, storing, and securing the personal information needed to process your transaction through its applications, databases, and data storage procedures. If you choose Shopify to process the payment for your purchase, Shopify is responsible for encrypting and storing your credit card and other personal information in compliance with the Payment Card Industry Data Security Standard (PCI-DSS) and generally accepted industry standards. Shopify is also responsible for retaining your personal information only as long as necessary to complete your transaction, and for deleting your information after your purchase transaction is completed. Shopify cookies are used on some of our Sites, and these enable Shopify to collect data about your device and activities on our Sites.
Shopify has its own privacy policy for the personal information they receive to process your purchase and payment transaction with us. We recommend that you read Shopify’s posted statements so you can understand the manner in which your personal information will be handled: Shopify’s Terms of Service (https://www.shopify.com/legal/terms); and Privacy Statement (https://www.shopify.com/legal/privacy).
Links to Third-Party Websites. Our Sites may include links to websites operated by our authorized dealers, home improvement retailers, and other third parties that have information we think may be of interest to you. If you click on a third-party link, you will be directed away from our Sites to that third-party website and any information you provide to that third-party website, or is collected from your usage, will be available to such third parties. The third-party website operator may collect your IP address or device identifier and other internet browsing data and may set a cookie to enable their features to function and track your usage. We recommend that you review the privacy policies of these websites before sharing any information with them. We have no control over and assume no responsibility for the content, accuracy, privacy policies, or practices of any third-party websites or services.
Social Media. Our Sites include links to our brands’ pages on social media platforms. If you activate a link to social media, that platform may collect your internet protocol (IP) address, set a cookie to recognize you, and collect information about your activities on our Sites. The social media platform may send us the information in your social media account that you make available to third parties through your account settings. We may combine information from your social media accounts with other information about you that we use for marketing purposes.
Your interactions with social media are governed by the privacy practices of the social media platforms. Please refer to the privacy settings in your social media account to learn about (1) what data is shared with connected applications, (2) how to manage the data that is shared through your social media account settings, including information about your activities using our Sites, products and services, and (3) how to disconnect a social media account from our Sites. This Privacy Policy applies solely to information under our control.
12. Your Rights
United States. If you reside in the United States, you have certain rights about e-mail and telemarketing messages as explained in the section titled, “Your Choices about E-mail and Telemarketing.” Depending on the state where you live, you may have certain rights regarding your personal information.
Most privacy laws require companies to notify individuals about their practices regarding the collection and use of personal information, including the categories of personal information collected, how the information is used, and to whom it is disclosed.
We will honor requests to exercise specific privacy rights granted by your place of residence as applicable to our operations. Regardless of where you live, we will respond to your request to:
- Access a copy of the personal information we have collected about you in the past 12 months, as well as information about our use or disclosure of that personal information.
- Correct any inaccurate or outdated information we may have about you.
- Withdraw any previously granted consent to use or disclose your personal information.
- Not be discriminated against if you exercise any of your privacy rights.
To submit a privacy request or exercise a privacy right, please contact us as explained in “How to Contact Us” below. We may need to request additional information to verify your identity. Where applicable laws set a timeframe for responding to consumer requests, we will respond within that timeframe. Otherwise, we will try to respond to a verifiable request within 45 calendar days of receiving it. We will contact you using the email address you provided when making the request or that we have on file. We do not discriminate against you for making a privacy request.
Nebraska and Texas. If you are a resident of Nebraska or Texas, you have the following data privacy rights (in addition to others that may be granted by law):
- The right to opt-out of the use of your personal information for targeted advertising purposes;
- The right to opt-out of the sale of your personal information; however, Derby Building Products does not sell personal information;
- The right to request access to and correction of certain personal information we have collected about you. When you request access to personal information, you have the right to receive that information in a usable and portable format;
- The right to request deletion of personal information, which we will honor subject to limitations permitted by law including for information needed for ongoing business purposes;
- The right to have your sensitive personal information used only for the purpose described to you at the time we collected the information;
- The right not to be discriminated against if you exercise any of your privacy rights.

To help protect the security of your personal information, we must verify your identity before we can respond to any requests regarding your data rights. If you or your authorized agent submit a request to access, delete, or modify your personal information, we will need to confirm your identity or the authority of your authorized agent to make such a request on your behalf.
We will respond to a verifiable request within forty-five (45) calendar days of receiving it, subject to delays and exclusions as permitted by law. If we cannot comply with all or part of your request, we will explain the reasons why. If we require more time to respond, we will let you know the reason and the extension period in writing. If you have an account with us, we may respond via that account. Otherwise, we will use the email address or U.S. Postal address you provided to us when making the request.
Canada. You have certain rights about e-mail and telemarketing messages as explained in the section titled, “Your Choices about E-mail and Telemarketing.” You also have the right to request access to your personal information, have your personal information updated or amended to correct inaccuracies or incomplete information, and (where technically feasible) to request a portable copy of your personal information, as defined under and subject to applicable law. You may also have the right to request deletion of your personal information or request that we no longer use it. You are responsible for the accuracy of the information you provide when using our Sites and services. Your right to access or correct your personal information is subject to applicable legal restrictions. We may take reasonable steps to verify your identity before granting access or making corrections.
13. Information about Minors
Our Sites are not intended for access and use by persons under the age of 16 (except in the case of legal residents of certain states where the legal age of majority is greater than sixteen (16) years of age, who then must meet the state’s legal age of majority).
